Looks like our Supreme Court is headed in the direction that will lead to the destruction of republican democracy as we, and history, have come to rely upon.
We are, with the seating of Sonia Sotomayor entering the age of situational justice which sounds the death knell of statutory and constitutional law. Law will come to be what individual judges decide it to be on an ad hoc basis relying on their own proclivities and biases. Such a system necessarily cannot rely on the Constitution nor case law as the legal theory of stare decisis has long dictated. It will necessarily, also, lead to judges of questionable character as they must take an oath to uphold the Constitution which they have no intention of doing and will instantly ignore. Judge Sotomayor has said on at least six documented instances over a period of 1994 until fairly recently she believes a female Hispanic can always reach a better conclusion than can a white man. Yet she, under oath, says over and over to the Senate Judiciary Committee she didn't mean it. President Obama has said it was a slip of the tongue. She calls it a "rhetorical flourish that didn't work." (try to define that one) The obvious is, a position oft stated over years is a philosophy, not a slip to the tongue. What do you think the Senate and the press would have done if John Roberts has said he felt a white man could always reach a more proper conclusion than a Hispanic.....black.........Asian......? President Obama has stated his desire to "break free from the essential constraints that were placed by the Founding Fathers and the Constitution," yet he blithely swore and oath to uphold the Constitution. He, it seems clear, intends to achieve this by appointing activists judges. People seem to have trouble is discerning what is an activist judge. Chief Justice Roberts likened a judge to an umpire in a baseball game. Sotomayer has publicly and often taken issue with this analogy. Justice Roberts is correct. In a baseball game the rules of the game are the Constitution and Statutory law. An umpire decides what he sees within the constraints of theses rules. Judge Sotomayor and others of her ilk would have you believe this is laughable. She would in a hypothetical case, call one who tried to stretch a single into a double and was clearly thrown out more that 3 feet from the base, safe. Her reasoning would be this poor player, two innings earlier, was robbed of a home run by a miraculous catch above the fence. This ruling would be indicated by her empathy for the poor player being deprived, so she had to right this horrible wrong. Don't laugh. This is what activist judges do. Remember Lady Liberty? She is always depicted as blindfolded with scales signifying the weight of the evidence rule her decision with no regard to who either party is. She is often shown with a sword in the other hand. This sword is always double sided denoting cutting both ways and fairness to either side. Is this the desired model for American Jurisprudence or is Sotomayor? You decide. She will be a great U.S. Supreme Court Justice... and you are correct that she is not the first Hispanic, but that isn't what the media has stated. Rather, they have said repeatedly, that she will be the first Hispanic woman to be a Supreme Court Justice.
I don't think she is the doomsday scenario that some have made her out to be. I am concerned that several of her decisions have been overturned and then there are the questionable comments she has made in the past but how many of us haven't made comments that seemed fine at the time but later were taken out of context.
But really, people should worry more about the next choice Obama makes if another member of the court retires or is no longer able to serve.
Darrick_04, you are actually wrong. I have actually seen several news media reports that have labeled her as the first potential Hispanic Supreme Court Justice with no mention of gender.
Darrick.........thanks for the comment...I have to take exception to your exortation that the media has "rather" said she is first hispanic woman....I probably peruse, watch and listen to more news sources than most and many, if not most, of them have repeatedly used the phrase "first hispanic Supreme Court Justice."
I also disagree with your first statement, then, that is a subjective opinion and you are entitled to it.
During the hearings she had "no opinion" on gun control, abortion, and several other issues.
I find this troubling, at best she has not considered the arguments of potential future cases, at worse she is lying to hide her true feelings. I believe it's the latter, given her past rulings, past inconsistencies, and obama's support of her.

Actually, quietmike, when I listened to the last two Justices' confirmation hearings they never came out and gave a clear opinion either.
Roberts said Roe vs. Wade was settled law of the land during his confirmation hearing.
I don't remember if he gave a position on gun control or if he was even asked.
I didn't see the Alito hearings, but we can plainly see they both gave the correct ruling on the Heller case.
Sotomayor has been a political activist on the bench based on her past rulings. Now when the spotlight is on her, she backpedals.

I find it troubling that you expect her to NOT rule on her "opinions", rather simply interpret law.. yet you are upset that she doesn't give her opinions. I thought opinions were what you didn't want her to have.
I didn't say I didn't want her to give her opinion, that's what judges do. I don't wan her giving ruling based on emotion, unfortunately it's too late for that in her case.
Sotomayor is a racist plain and simple, sure she cleaned up her language, and her act, for the hearings, much like a criminal does when he goes to court. I put more weight in her actions and rulings over the years than I do in her act while she is in the spotlight applying for a job.
Right, so judges aren't allowed to be human. If judges aren't to evoke emotion into their decision then let's replace the Supreme Court Justices with elaborate robots who can scan the pages of the Constitution and apply it without emotion.
No judge is supposed to take it upon themselves to legislate from the bench via emotion or "feelings" Judges are supposed to apply the law. Henceforth "True justice is blind" After all, emotions are the one thing humans have the most of, yet understand the least about.
FACT: If ANY caucasian nominee had made the same statements she had, they would have already been forced to withdraw their nomination. If people REALLY wanted to be treated "equal", they would demand the withdrawal of her name from consideration. However, liberal thinking always supports having a double standard rather than true equality.
The comment she made was not racist... Read the entire context of what was said, rather than a soundbite played repeatedly. Remember the media that all the Conservatives bashed over and over for loving Obama? That would be the same media that "spun" her words into meaning more than it should have. How many cases has she had reviewed and overturned by appellate courts? Very few. I think it is something like 2-3%. Again, the alternative would be to nominate robots, perhaps we should give that a try.
