Public Chapter 1112

Posted Thursday, March 10, 2011, at 11:59 AM

An article titled "Immigrants Feel New Laws Chill" was published in the Times Gazette on Wednesday, March 9th. If you haven't read the article, you can here, http://www.t-g.com/story/1709149.html . The topic of the story was a new law, Public Chapter 1112, which went into effect January 1, 2011. The basis for this law is that when an individual is arrested, booked or retained in a county or municipal jail, the keeper of the jail shall verify the citizenship of the individual.

One important thing to notice is that the law states "individual", it does not single out any nationality or race. If said "individual" cannot prove that he or she is a legal citizen of The United States, then he or she will be reported to the Immigration and Customs Enforcement Detention and Removal Operations (ICE) office. Plain, simple and to the point don't you think? If you are caught breaking the law and cannot prove your legal citizenship in this country, you could be deported.

What I fail to understand is why the group Statewide Organizing for Community eMpowerment (SOCM) has an issue with this. They state that "as of March 1, 2011, that 20 people in Bedford County were being held under an ICE designation compared to only 2 people a year ago." Makes sense considering the law just went into effect at the beginning of this year. I think that translates to, the law is working!

Some local members of SOCM, state that they will lobby against more legislation that they describe as "anti-immigrant bills that weaken Tennessee communities and economy." So does that mean that the members of SOCM consider the Public Chapter 1112 to be anti-immigrant, because after reading this bill it appears it was written to be anti-illegal immigrant bill? The SOCM members go on to say that "they will call on legislators to vote 'no' on immigration bills that prevent the Hispanic population from learning to speak English, hold jobs, protect families and create a sense of community in Tennessee."

Wonder why the SOCM has singled out the Hispanic community in their statement? If you read the Public Chapter 1112, you will notice as I stated earlier that no nationality or race is singled out. The SOCM website claims they are "anti-racist" but yet they make a point to single out Hispanics as if any legislation that is directed at immigration is solely directed at Hispanics. Another issue is they claim there are bills being proposed that prevent Hispanics from learning English? If anyone knows of such bills please let me know, because this is one I would agree should be trashed. As far as other proposed bills that the SOCM claims to prevent Hispanics from holding jobs, protecting families, etc. I question if these bills do indeed contain language to back their claims or maybe do these proposed bills direct attention to "illegal" immigrants as does the Public Chapter 1112.

One local SOCM member and business owner, Antonio Perez stated that "we are clearly seeing an increase in arrest" and "Now, people say, 'I'll just leave rather than wait around to get arrested for nothing," I would say Mr. Perez that if you are seeing an increase in arrest, it is because crime has increased not because of the enactment of Public Chapter 1112, and those you claim say they will leave rather than wait on being arrested, must have a reason to fear being arrested. One might assume that they are here illegally, otherwise why would the Public Chapter 1112 law concern them? This statement is also true for the clients of a local attorney who claim to be "terrified" of the passage of Public Chapter 1112. Those that are terrified of this law are so because of one of two reasons. One they break the law or plan to break the law and risk getting arrested and second they are here illegally. Those are the only logical reasons to be "terrified" of the Public Chapter 1112 law.

If you would like to read the Public Chapter 1112 bill you can here, http://state.tn.us/sos/acts/106/pub/pc11... . Also if you want to learn more about the SOCM, their website can be found at, http://www.socm.org/

This law is long overdue.

I find it odd that there aren't activist groups bemoaning the enforcement of the laws they were originally arrested for...why is enforcing immigration laws any better or worse than enforcing others?

It is sad that the Federal Government has not enforced it's own laws concerning illegal immigration. The borders have been open too long! Illegal immigrants have taken AMERICAN JOBS, Over-crowed our schools, and overwhealmed our Health Care System. AMERICANS are unemployed, Without Insurance for health care, not to mention drug/gun smuggling and kidnapping our inocent children and keeeping them in the SEX SLAVE TRADE!!

A corrections Officer told me they deported an Illegal back to his/her country and he/she was back in Shelbyville within 3 days. I support our new Public Chapter 1112 Bill-and shame on our Federal Government for putting States in the position we are now in. WAKE UP AMERICA!!!!

Our nation's borders, language, culture and sovereignty are all being destroyed in the name of political correctness. It's time to take our country back.

I agree with ckna910 and Tim Lokey.

We need to call/write our State Representatives in Support of SB0010 concerning Driver's License Testing in English Only and HB1380 concerning traffic stops and local law enforcement reporting illegals.

I wonder if all the 100-plus members of SOCM are here legally?

I am also tired of having to choose my language when making phone calls. If someone is in our country, they need to learn our language. Their language should not be forced on us.

AMEN to all of the above. And companies like Tyson and Corsicana bring foreigners into our town and give away the jobs that our citizens are in need of.

We have made many concessions over the past few years in letting them take over our jobs, health care benefits, and other free programs. And now every foreigner that comes to the U.S treats us like they are entitled to what WE have worked for. Just try going to Mexico and break a law, a small, insignificant law by our standards, and see what the consequences would be. The ruler of Mexico is not a friend to the U.S. When someone is deported back, that government should deal with them, but they turn a blind eye. They don't want to deal with them and that is why they are back in just a few days. Mexican rulers don't want "undesirables" in their country. This is the term he has used many times with the lower class in his country.

Our government is to blame and it has happened over decades of the U.S. giving so many handouts and so much foreign aid instead of taking care of the people in need that are U.S. citizens and have helped to build this country. But over the years, there are those business owners that have gotten greedy for the sake of their own pockets and have shipped our industries out of this country or brought in cheap labor to make them millions. Those are the ones that need to be shipped out of our country along with their factories. Foreign aid should stay here to help those out of jobs and struggling to make ends meet and to feed their families and give them a decent place to live.

I guess this is the day for me to be on my soap box because my family had been effected by the no-job situation. I try to help them as much as I can, but I am limited to how much I can do, too.

All I can say is...about time!!!!

I agree with all of the above and I too, may add that it is way past time our laws were enforced.

I quit buying Tyson products when I became aware that they hire foreign workers over local people.I know a lot of others that quit buying too.If more people would do this to any company that hire foreign instead of americans we might make a difference. Also we might need to go to the streets to protest and kick the elected officials out of office.I'm waiting to see if any of the laws that passed make a difference but????????????

Hooray for Tennessee Lawmakers. (Maybe)

However, how does that differ from existing laws.

They can hold anyone for questioning for 48 hours without charging them.

They can't bail out until after the 48 hours if they keep them.

Only thing I see is they get to call the ICE to pick them up and deport them, but the sheriff said ICE may come and get them or they may not. How does that make it a great law.

And if they bail out and don't come back for trial, if one is required, how does that or any American law stop these invaders.

Have to sick Dog the Bounty Hunter on them.

So... if the Sheriff just sets them free after 48 hours, that is no different than ICE setting them free.

Mexico is having so much trouble with the drug lords, ICE and DEA that they are asking anyone to come in and help the Mexicans out. You Know... like the Libyans and rebels did in Libya.

Sorry, the US isn't going to go in and help our neighbors out. Obama could bring our troops home from Irag and Afghanistan and employ them in Mexico and Central America.

Hey, maybe our government will shut down at midnight Friday, then all the Mexicans can just walk right on in.

Since the T-G doesn't have anything about the budget, I want to say that the government needs to lay off employees just like every other corporation.

If we have to lose our jobs because of the government spending, then all the employees need to be laid off also, BUT WITHOUT PAY! No retroactive payments when they are rehired.

The only way the government can keep going is to spend more money to pay itself. That makes our money worth even less. We will never raise out of this recession. It isn't getting any better. President Obama is just tell you more Unique Lies.
