Amy Coney Barrett Supreme Court Nominee
Lately with the nomination of Amy Coney Barrett we have seen her opponents accusing her of being a Constitutionalist / Originalist Judge. One who evaluates cases coming to her based on the Constitution and the original meaning of the writers of this document.
Isn't that what the Supreme Court is for, interpret law based on the Constitution? Here is a description of this type of judge by Supreme Court Judge Neil Gorsuch. It brings us back to the "straight and narrow" and in today's world that might be more important than ever.
The Living Constitutionalists believe the Constitution should be interpreted by what is thought to be the will of the people. That sounds great until you realize that Living Constitutionalists allowed segregation until 1954. It seemed to be the will of the people but doing that allows things to swerve into areas that could be dead wrong.
What if folks from other Nations who believe in differentl rights for men and women got appointed to the Supreme Court as Living Constitutionlists? They could decide women lose the right to vote, that women belong to men, etc.
