Hardin suspended from judicial commissioner post

The Bedford County judicial commissioner accused of soliciting sex while on duty has been removed from his position pending outcome of the case.

Billy Hardin, 59, of Shelbyville has been suspended without pay, General Sessions Judge Charles Rich said Wednesday.

All judicial commissioners in Tennessee are under control of the court system and essentially work for judges.

Rich said he has no choice but to recuse himself from hearing the case scheduled April 9 at Bedford County Courthouse.

The state administrator of courts will appoint a general sessions judge from another county to step in for Rich.

Hardin allegedly offered $25 for oral sex last weekend to a woman who was consulting him about warrants she filed, authorities say.

He has been charged with official misconduct, sexual battery and soliciting prostitution.

Judicial commissioners hear allegations and determine whether charges should be filed and make decisions such as bond amounts.

If government officals,police officers,

senators,judges,mayors, etc, etc.can be suspended with pay for much worse allegations!!...... why not this commissioner? Doesn't seem right to me since he hasn't had his day in court.

Billy Hardin is getting blew up like a huge balloon. He has not been proven guilty nor inocent, but until proven guilty all the jibberjabber is really useless. Everybody wants to bring him down just because he is the bad guy, that issues warrants at the jail. MY OPINION THE TBI NEED TO COME AND INVESTIGATE THE WHOLE JUDICIAL AND LAW ENFORCEMENT IN BEDFORD COUNTY. AND IM SURE THEY WOULD FIND MORE THAN THIS GOING ON.

To morefreeadvice. I am not Billy Hardin. Close personal friend, family member, someone who knows him. Now you are close. You all have a right to speak your mind, just as I have. Billy would not want me doing this, but I did. I just thought there might be more open minded, fair people out there. Guess I was wrong.

i have known mr. harden for years i will never believe that he would ever do anything to mess his career up i had a foster child in the early 90s and he was the one to have to check on him he was respectful i hope this gets settled soon i would like to wish mr harden and his family my prayers

It must be someone "high up" to get a warrent against him.... or maybe the county is out of money. Wed the docket was not full .

there is one thing that everyone has to understand ther is federal law,state law,local law, and not to mention bedford co law , its in a world of its own. just goes to show what kind of judicial people we have running the county.

The deligated authority carries with it a standard of conduct that hold the office to the standard of the deligating authority.

(g) When the offender is a law enforcement officer, correctional officer, or correctional probation officer as defined by s. 943.10(1), (2), (3), (6), (7), (8), or (9), who is certified under the provisions of s. 943.1395 or is an elected official exempt from such certification by virtue of s. 943.253, or any other person in a position of control or authority in a probation, community control, controlled release, detention, custodial, or similar setting, and such officer, official, or person is acting in such a manner as to lead the victim to reasonably believe that the offender is in a position of control or authority as an agent or employee of government

If Mr. Hardin is reinstated in his position due to a not guilty finding, he will recieve 100% of his back pay in his next check. Standard county pay procedure.

If I was to get suspended from my job or just did not work, then I would not be paid either. What makes Billy Hardin so special that he should be paid even when suspended? snoopyman & Onlyme, you are both free to pay this man out of your pocket, but I'm glad my tax money is not being used to pay him while suspended. If he should be found to be not guilty, then perhaps he will be due some type of compensation, but there again he should probably seek that from the person making the accusations, if they turn out to be false.

That's a good question, along with many others. Why without pay? Has he already been convicted and found guilty? Has he had his day in court? Has he admitted guilt? All I heard was he had no comment.....Innocent until proven guilty apparently doesn't apply in Bedford County.

Why suspended without pay? Is he accused or guilty? I think Mr. Hardin was fair, and that's a lot more than I can say about most in the Bedford County Judicial System.
