A man facing charges of vehicular homicide for the death of a Unionville man appeared briefly in court on Thursday.

Kimery Wayne Hill, 28, of U.S. 41-A North, is charged with one count of vehicular homicide in the death of Robert "Bobby" Brown, 69, of Unionville.

He also faces four counts of reckless endangerment, one count of second offense driving on a suspended license, one count of reckless driving and a probation violation.

Hill is being represented by attorney David McKenzie, who said his first job is to investigate what occurred.

"The real key to this case is to find out what happened, what was going on," McKenzie said.

Brown was killed on April 28 after he was struck in his front yard on U.S. 41-A North by a truck driven by a Tullahoma man, Timothy A. McGehee, 43, after it was allegedly hit by Hill's car.

Law enforcement investigators stated that Brown was standing near the shoulder of the highway near a large Lowe's truck that was parked there while the driver was preparing to unload shingles.

According to a report by State Trooper Chad McAnally, the Hill and McGehee vehicles were headed south and Hill attempted to pass McGehee and allegedly struck the rear of McGehee's truck.

The McGehee truck collided into the front of the Lowe's truck, then spun around and struck Mr. Brown, who was thrown 20-30 yards from the point of impact and died shortly thereafter at the scene.

A passenger in Hill's car, his 3-year-old daughter, was not injured.

Moments before the fatal accident occurred, Deputy Tracey Harvey reported seeing Hill speeding down 41-A North. He was notifying other officers and turning to pursue when the accident occurred.

Hill allegedly sped away from the scene, but law enforcement was notified almost immediately as to where he had driven. His 1991 Acura Legend was found parked in a field with the smashed front end next to a fence row.

Officers said at the time they suspected the car had been intentionally parked in that location in an attempt to hide damage.

Brown was employed at Lowe's and was also a retired electrician. No members of the Brown family were present in court Thursday.

Hill is being held at the Bedford County Jail on $127,000 bond. He will next appear in Bedford County General Sessions Court on June 5.

the story says Brown was killed on April 28 after he was struck by a parked Lowe's truck.. then it says the McGehee truck hit him. how can a "parked" vehickle hit anyone?? it appears plain and simple to me. bobby, tim, and the lowes driver were all a victem of hill's stupidity, and bobby suffered the wore end of the deal

First off Mrs. Brown, My familie's thoughts and prayers go out to you and Troy and family. May GOD give you peace and comfort in your time of loss. I hope Hill is treated fairly by our judicial system and the law of the land prevails. I hope Hill's daughter is ok in all she saw.

farmerman...the story says he was standing next to the parked truck, but was actually struck by the vehicle driver by Tim McGeHee which was struck by the nut job in question. Hope that made sense =)

Personally, I hope this creep gets every ounce of justice he deserves...he'll definitely get it here in Bedford County!

we dont know all the facts, and this was an accident. He apparently was not drinking or on drugs. Im not saying what happened was not tragic but come on, its a freaking accident. Any of you commenting on this ever make a mistake while driving.

just my thoughts.

Brett, I couldn't agree with you more!!! There are to many people who worry about others mistakes instead of their own. Yes, Kimery made a bad judgement by leaving and he will have to pay the price for his mistakes. How many of you have made mistakes in your life that you wish you could take back? All this about Kimery being on drugs and drunk is just plain gossip. Nobody but Kimery & the hospital know the truth about that, and with the hippa laws I am sure no staff member of the hospital is talking about his info.To those of you who like to call people names because of the mistakes they have made(NUT JOB)I think you should sit back and ask yourself if Mr. Brown or GOD at that would be making such comments about Kimery. NO, they wouldn't.I will say this to you all who think it is your job to judge people, JUDGE NOT LET THE BE JUDGED.

I agree with wrongiswrong on this one. Have compassion for those who are left behind and affected by this tragedy and let the justice system deal with Mr. Hill. He will be judged by a jury and I hope the justice is true, swift and severe. A vehicle is just as deadly as a gun and someone who has already proved himself unable to control either himself or a vehicle deserves the maximum penalty.

farmerman...It does not say that he was struck by a parked Lowe's truck....It say's that the Lowes truck was hit in the front by the other truck and then it spun around and hit Mr. Brown...You need to read the story over again....

sumpig...yes, we have all made bad decisions..but how many of our bad decisions cost the lives of innocent people? I know none of mine have. We all make rash decisions every day, but driving like a maniac with my toddler in the car is not one of them, nor is running down other drivers on the road and leaving injured civilians in my wake! I am not judging him, as a human on this Earth that is not my place. However, I am entitled to my opinion, as are you. I referred to the perpetrator in this story as a nutjob because his actions were far from that of a sane person or even a rational one. If he was not under the influence of any intoxicant or illegal substance at the time of the accident, then that means he did all of this while stone-cold sober...and personally that scares me more than if he were 3-sheets to the wind...at least then we could blame the booze. I was not there that day, and have no idea what demons Mr. Hill had that may have caused him to do what he did. But, I do not have any sympathy for him.

First off this is the real story!!! Im kimery's little sister and I dont know who has started the rumors that my brother was under the influence but the results came back and he was not. And furthermore Kimery did not "RUN" he had my 3 yr old niece in the car and he didnt want her to be scared for the rest of her life by having to see a dead man in a ditch and daddy going to jail while she had to wait with a complete stranger for mommy to come get her.Kimery is a great dad and Rylie misses her daddy very much. Our family is going through a lot right now as well and I do send out my sorrys for their family as well I know they are going through more than us seeing as they lost a loved one and we can see ours every week but I only wish yall can stop bashing him. It's not like he woke up that day saying"Oh I think I will kill a man today." And as for Kimery's childhood you have no idea what went on and that has NOTHING to do with what has happened so stop judging him when you need to be looking in the mirror picking at your flaws and not his.

I understand that your family is going through alot also dealing with the fact that your brother caused the death of an innocent man. I know that he can recieve forgiveness from God if he asks also. I can even understand you getting on the defensive a little bit, but look at the facts. If your brother had not been driving on a revoked liscense and he had not been speeding this type of accident would not of occurred. We all make mistakes but when we continue doing those same things that we know are against the law, then apparently Mr. Hill was not sorry at all. i do not wish bad for your family and I hope your brother sees the error of his ways. I also hope that people do not sit in judgement of the other members of your family for your brothers serious lack of judgement. To mr. Browns family I hope the Lord gives you comfort in your time of grief.

Jesuslives, I totally agree with you. We all have to understand that there is consequences when we break the law. He was driving with no license. I am sure many people are asking.... Why was he driving at all? Especially with a young child in there too, that makes it worst. We all know that there are folks who drive when they are not supppose to, but they must remember it has a consequence and will catch up with them eventually. Its too bad this time that it had to take someone's life. Everyone involved is disturbed about this accident. It has touched a lot of lives.

Then why did he try to hide the car in a field?

It's not like he woke up that day saying"Oh I think I will kill a man today."

-- Posted by Jessica_HiLL_SMACKS on Sun, May 11, 2008, at 11:09 AM

No, but he did choose to drive away, knowing that someone was injured or dead. There is no excuse for that.

Totally agree! I think he was running totally out of fear and the emotional stress that might be caused on the child had nothing to do with it! Again just my opinion. I don't think I'd attempt to run that by a jury as justification for his actions.

-- Posted by Dolittle on Mon, May 12, 2008, at 8:52 AM

I know all of this isn't going to bring Bobby back to his family, plus he is in a better place now. The point is that his family wasn't ready for him to go. Also for the child in the car shouldn't wittness anything that bad. I just hope that the guy that hit Bobby learned his lesson, plus he has to live with it the rest of his Life. Because him and God the only one that know what happen. That he shouldn't be aloud to drive anymore if he does get out of jail. Becauses I wouldn't want to know he is back on the roads.

you people really need to get a life you read the paper about a accident or anything else thats in the news and then start making your comments like your are a judge you need to leave people alone and write comments on what you do wrong in life you i am sure you have family members that might do something wrong or get killed one day would you like BAD comments wrote about you ( let the people alone )and get a life

thanks to those who corrected me. i did read the story and when i said "Brown was killed on April 28 after he was struck by a parked Lowe's truck"... i copied and pasted it from the article itsself. i suppose the t-g caught it and corrected their article. but oh wel no biggie. i am sure if mr hills daughter was sitting in her yard playing, and a known traffic offender ran off the road and killed her th3n left to go and hid their car, his family and friends would just dismiss this as just a mistake and move on..YEAH RIGHT!!

-- Posted by farmerman on Mon, May 12, 2008, at 12:59 PM

Dump Truck Driver, I totally agree with you. Those who violate the driver's license laws know the consequences if caught. What I don't get is if he didn't have a license and made the choice to drive against the law, then why on this Earth did he drive recklessly? I mean, his driving caught the attention of a Sheriff's Deputy before the accident even occurred! Obviously there is a reason he doesn't have a license...he has no judgement at all.

-- Posted by jtjustice30 on Mon, May 12, 2008, at 1:30 PM

"I wonder if he even knew that Mr. McGees's truck struck Mr. Brown." I bet he thought all he did was hit the back end of McGees' truck and tried to keep going, No license, Ins.

Jessica_HiLL_SMACKS, I know it is hard, and it hurts to read the comments about your brother, and that you want to defend him. That is natural. But it is best that you do not post about your brother, the accident, or his case. And his attorney should have advised you and the family of this as well.

Everyone does things they should not, some worse than others. Sometimes these things causes harm to others, whether we meant to or not; and in this situation a man Lost his life, and a family lost their loved one.

Perhaps this tragedy happened to bring Hill to the Lord. Do any of you think that Bobby would want you talking this way about Mr. Hill?

I didn't know either of the victims here, but, from what I have read, I really missed out by not knowing Bobby.

I can almost bet that Mr. Hill is eat up with is guilt and what occurred. Anger is not going to help anything. Justice will prevail. Keep Bobby's memory alive and never forget what he stood for.
