Officer uses Taser against suspect

Thursday, June 26, 2008

A Shelbyville police officer says he was forced to use a Taser on a suspect who allegedly resisted arrest late Saturday night.

Officer David Curley, who was responding to calls of a man screaming and smashing mailboxes on West Lane Street, said he found Billy Joe Colburn, 18, Hobson Avenue, walking in the middle of Earnhart Street.

Colburn ran away, then walked toward Curley with his fists clenched, the officer said.

Curley said he held the Taser on Colburn, ordered him to the ground unsuccessfully several times, then repeated the order while placing his hand on the back of Colburn's neck.

Colburn began swinging "wildly," Curley said, and allegedly struck him in the chest with his elbow and forearm.

"Mr. Colburn stumbled away three or four steps and I discharged my Taser, striking Mr. Colburn in the back," Curley said in his report.

Colburn fell to the ground and complied with orders, Curley said.

Other officers disconnected the Taser from its cartridge, removed the prongs from Colburn's back and cleaned the wounds with alcohol swabs, Curley said.

Colburn was charged with vandalism, violation of the drinking age law, disorderly conduct, evading arrest, assault and public intoxication, and posted $10,500 bond, Bedford County Jail records show.

Short search

City and county officers and a search dog were called before a Shelbyville man was captured after allegedly attempting to elude an officer on foot Saturday.

Wayne Shelton Jr., 27, Mullins Chapel Road, allegedly ran from Officer Jody Shelton at the Golden Gallon store on Madison Street.

The officer had been told Shelton threatened a woman in his car. The woman asked to go into the store to buy a snack, then called police, Officer Shelton said.

Wayne Shelton ran across Madison Street to thick brush on Stokes Cemetery Road, where he hid until Deputy Caleb Doak found him and ordered him at gunpoint to surrender, Officer Shelton said.

The suspect told Officer Shelton he ran due to several active arrest warrants.

Wayne Shelton was charged with resisting stop/frisk/halt/search, public intoxication, theft of property, evading arrest, vandalism, violation of parole, according to Bedford County Jail records, and is being held without bond.
