Aug. 21 is the day when Kimery Wayne Hill, 28, of U.S. 41-A North, will learn if his case will proceed to Circuit Court, according to defense attorney David McKenzie.
Hill is charged with one count of vehicular homicide in the death of Robert 'Bobby' Brown, 69, of Unionville. He also faces four counts of reckless endangerment, one count of second offense driving on a suspended license, one count of reckless driving and a probation violation.
The August date will be the last day Hill's case is in General Sessions Court, McKenzie said.
If the judge decides the case needs to go to Circuit Court, then he will schedule an arraignment day for Hill, McKenzie said.
"At this point, what I'm trying to do is to make sure that the case is handled properly and respectfully," McKenzie said of Hill's case.
Brown was killed on April 28 after he was struck in his front yard on U.S. 41-A North by a parked Lowe's truck that was hit by another truck driven by Timothy A. McGehee, 43, of Tullahoma, after it was allegedly hit by Hill's car.
Investigators stated that Brown was standing near the shoulder of the highway near a Lowe's truck while the driver was preparing to unload shingles.
According to a report by State Trooper Chad McAnally, the Hill and McGehee vehicles were headed south and Hill attempted to pass McGehee and allegedly struck the rear of McGehee's truck.
The McGehee truck collided into the front of the Lowe's truck, then spun around and struck Brown, who was thrown 20-30 yards from the point of impact and died shortly thereafter at the scene, the report said.
A passenger in Hill's car, his 3-year-old daughter, was not injured.
Moments before the fatal accident occurred, Deputy Tracey Harvey reported seeing Hill speeding on 41-A North. She was notifying other officers by radio and turning to pursue when the accident occurred.
Hill allegedly sped from the scene, but law enforcement was notified almost immediately as to where he had driven. His 1991 Acura Legend was found parked at an Old Unionville Road home with the smashed front end next to a fence row.
Officers said at the time they suspected the car had been intentionally parked in that location in an attempt to hide damage.
Brown worked at Lowe's and was a retired electrician. Hill is being held at the Bedford County Jail on $127,000 bond.


Amen Dolittle. Thank goodness the little girl in the car was not physically injured, although I'm sure she will have some psychological trauma for years to come. We need to all keep the Brown family in our thoughts and prayers.
Hopefully justice will be served and Hill will have a long time to sit behind bars and think about the life he took through this selfish and cowardly act!
