A deadlocked jury has resulted in a mistrial in the case against Ashley Cook, who is charged with the murder of Bill Ross.
Cook, 23, is charged with first degree murder and conspiracy to commit first degree murder in the Feb. 14, 2007, murder of Ross, a Shelbyville car salesman.
Judge Robert Crigler granted the defense motion for a mistrial Friday just before noon after the jury in the case deliberated over a four day period.

I sat through the trial, because I have to sit through another one in 5 months. The state presented a good case, they gave compelling evidence. As far as Ashley getting 2nd degree murder, they all were masterminds in this case. She was to make 1 other attempts, before the final one that killed Mr. Ross. So giving one less than the other, they all had planned it. And Ms. Cook was to the pulled the trigger every time the plan was discussed. The state was well prepared. I don't know what was the thinking of the one juror or the one that finally side with them, but if I was sitting on the jury it would be a hands down decision.
i hope she gets 2 degree mrs. ross is the mastermind behind all this
Sounds like a repeat of the killing of the Holden Children.Their dad still sitting in jail after all these years. Those poor children, like Mr.Ross did not ask to have their life snuffed out. And the ones who are guilty. Are still alive and breathing? Some thing wrong with this picture. No wonder there is so much crime in this world.Set an example,if they do the crime, make them pay the price.

Wheelbillie, you might want to read the news more often. Holton was executed 9/12/2007 in perhaps the last execution by electrocution in TN.
Here is a link to read all about it:

Also everyone should just chill out, because this case is far from over. Cook is still in custody and will face a retrial with a new jury and a chance for the prosecution to improve their case. She will end up going to prison for a long time, but it is a shame that the extra cost of another trial will be added. I would not be surprised if the state offers her a plea bargain that she cannot refuse. Any bets anyone?
Seems to me like it was premeditated, that is, to commit a crime or to do some other thing "before" it is done.
--- Young, allegedly loaded the gun and 'Cook entered the home to shoot Ross' -in order to make- the death look like part of a home invasion. ---
Who pulled the trigger? Ashley Cook
sounds just like the preacher's wife who cold blooded killed him in Nashville & they let her go FREE! Janet winkler was her name & she is out partying & her poor huband died for no reason.
She'll never walk even if it takes 10 trials. Eventually they'll find 12 people in Bedford County who have more than IQ of 50. It may take 10 trials for that to happen, but they'll eventually get a jury that will convict her. Darn shame we have to fit the bill for these trials until it happens.
I must point out that Ms. Cook is still in custody. Even though there has been a mistrial, she is still facing murder charges and I doubt they will be letting her out anytime soon.
I ment to say, After all those years Mr Holden sat in jail. And his children were dead and gone. He finally paid his dues. But look at all the money that went into that case.
When some one kills on purpose, it should be a done deal.No trials, no wasted money spent. And no getting off because of a insane plea.
I feel sorry for the Ross and Holden Family members, who have to sit and watch on TV and in newspapers. The re hasshing over the media coverage.
But if this woman gets a miss trial. I wonder how long it will be before the next murder happens?Because the next one will think that they will get off too.
May I ask "Why Do We Even Bother Bringing The People Who Kill People In?"
It's a waste of tax payers money. They sit in jail,we the tax payers support them, pay for their lawyers.
Who in Bedford County has the right to allow this woman to go free after she killed someone ?
Who ever it was, I'd like them to face Mr.Ross'mother or father. As the innocent man slept. This woman admitted to killing him.(in cold blood)Whats this world coming to?
Sounds like a repeat of the killing of the Holden Children.Their dad still sitting in jail after all these years. Those poor children, like Mr.Ross did not ask to have their life snuffed out. And the ones who are guilty. Are still alive and breathing? Some thing wrong with this picture. No wonder there is so much crime in this world.Set an example,if they do the crime, make them pay the price. If they knowingly kill some one. Stop wasting money,Send them to the famous chair. Then there won't be no re peat crimes.
So, will it be retried or do they let her go. The system seems to fail so many, but then they will hang a man to dry for something minor. What is wrong with Bedford County?????
sounds like the jury was bought off
I just can not believe this....How can they do this when this man was killed cold blooded while he slept....But his wife was put away for planning the murder but did not kill him ...This woman shot him and is going to be let go....Did I miss something or read something wrong !!!!!!
A case of the White woman blame it on the black man syndrome. All three are guilty of Pre-meditated murder, and should face the Death Penalty.
Amazing! Just an example of "Clear Thinking".
Has this ever happened before and if so when? Someone fell asleep during the juror selection or maybe during the trial. It's not the end though, justice will prevail.
I have to agree with Dolittle and Fromcornersville. The one person who could not see FIRST DEGREE MURDER has to be stupid or awfully dumb. She admitted to shooting the man while asleep in his bed and in his own home. She knew exactly what she was doing that night and no one was holding a gun to her head forcing her to kill an innocent man. That is what's wrong with the world today people go out and murder people for no reason and nothing is done about it. The DEATH PENALTY should be enforced more than what it is then people might think before they commit acts of violence like Cook,Young and Kimberly Ross did. To the one person who couldn't decide you should take a long look at yourself in the mirror.
Are you KIDDING? I have been following this case, and it seems to me the first night this girl went out, when Kimbery faked her "stroke", she had every intention of killing this man!! She just either freaked out and backed out of it, or something got in the way of her offing him then! This is UNBELIEVABLE that every jury member could not see this. This woman is giving an "AWARD WINNING" act also. Like they say, like mother, like daughter. Breaking down right before she was to go to the witness stand. "BRAVO" lady for making jury members feel sorry for you while an innocent man is dead!
According to Wikipedia:
Mistrials
A judge may cancel a trial prior to the return of a verdict; legal parlance designates this as a mistrial.
A judge may declare a mistrial due to:
* The court determining that it lacks jurisdiction over a case,
* Evidence being admitted improperly,
* Misconduct by a party, juror, or an outside actor, if it prevents due process,
* A hung jury which cannot reach a verdict with the required degree of unanimity
* Disqualification of a juror after the jury is impanelled, if no alternate juror is available and the litigants do not agree to proceed with the remaining jurors.
A declaration of a mistrial generally means that the court must hold a retrial on the same subject.
An important exception occurs in criminal cases in the United States. If the court erroneously declares a mistrial, or if prosecutorial misconduct forced the defendant into moving for a mistrial, then the US Constitution's protection against double jeopardy bars any retrial; so the prosecution must be terminated.
In this case, it was a deadlocked or "hung" jury.
What happened for a mistrial to be called?
Boy never saw that coming.......One idiot has too much power to cost the taxpayers all this money for a re-trial. If you take gloves to a house to hide finger prints on a weapon you fully intend to use to MURDER someone how could an idiot not see that it is MURDER IN THE 1st??? I have to seriously question the DA who allowed such a moron to be a part of this jury!
