Kimery Wayne Hill is charged with vehicular homicide in the death of Robert 'Bobby' Brown, 69, of Unionville. He also faces eight counts of reckless endangerment, one count of third offense driving on a revoked license, and one count of leaving the scene of an accident.
Hill appeared briefly in court before Judge Robert Crigler Monday and his next court date is set for Oct. 20. Last month, Hill waived his right to a preliminary hearing, saying he "did not want to cause the Brown family any more grief," according to his attorney, David McKenzie.
Brown was killed on April 28 after he was struck in his front yard on U.S. 41-A North in a chain-reaction collision in front of his home. Investigators stated that Brown was standing near the shoulder of the highway near a Lowe's truck while the driver was preparing to unload shingles.
According to a report by State Trooper Chad McAnally, Hill attempted to pass a truck driven by Timothy A. McGehee of Tullahoma and allegedly struck the rear of McGehee's vehicle.
The McGehee truck collided into the front of the Lowe's truck, then spun around and struck Brown, who was thrown 20 to 30 yards from the point of impact and died shortly thereafter at the scene, the report said.
Also indicted Monday by the grand jury were:
* Daniel Lee Brandon, 19, aggravated burglary, theft over $500.
* Juan Aguilera Cardenas, 45, habitual traffic offender, DUI-4th offense, violation of implied consent.
* William Dean Carter, 42, sale of schedule VI drug (two counts), delivery of schedule VI drug (two counts).
* Donald Deakle, 45, sexual exploitation of a minor, (three counts) solicitation of a minor (three counts).
* Danta Hix, 22, sale of schedule II, delivery of schedule II, evading arrest, reckless endangerment.
* James Edgar Leverette, 44, theft over $500.
* David Thomas Nowlin, 25, jail escape.
* William Nathan Smith, 37, theft under $500 (five counts).
* Reuben Starnes, Jr., 36, sale of schedule II, delivery of schedule II, conspiracy to sell and deliver schedule II.
