Racers' case goes to grand jury

Following a five-hour preliminary hearing, an auto racer and his brother were bound over to the Bedford County grand jury on a number of assault charges.

Marvin Bobby Parker faces five counts of aggravated assault and a single count of misdemeanor assault while his brother, Mike Parker, is facing a single count of aggravated assault. The grand jury is scheduled to convene Monday, Oct. 20.

The charges stem from an incident that allegedly occurred at Duck River Speedway June 7. According to a report filed by Shelbyville police officer James Wilkerson, who was employed at the Speedway as a security guard, he was dispatched by track owner Jim Hastings to investigate a report of a man hit by a vehicle on pit row.

Warrants charging Marvin Parker with five counts of aggravated assault were filed by James Smotherman, Jr., Gary Epperson, Christopher Smotherman, James Smotherman, Sr., and Karl Duke, which claim Parker attempted "to run over several of the patrons and did strike and injure one individual requiring medical treatment and extensive damage to his face, arm, leg and back that will require corrective surgery."

"The other affiants narrowly escaped being struck and suffered cuts and scrapes to their persons," the warrant states. "One of the individuals was a 12-year-old child."

According to the police report, Wilkerson observed a large crowd near the alleged incident and was told that Chad Smotherman was the victim of a vehicular assault by Marvin Parker. While Wilkerson and officer Mike Davis were at the ambulance, "we received information that the Parker Brothers were attacking Jim Hastings."

The report also said that Mike Parker attempted to strike Hastings with "a pipe-like object."

The officers went to the Parkers' pit area to attempt to learn what occurred, the report states. "While investigating said offenses, Mike and Marvin Parker became enraged at Hastings for no legitimate reason and began striking him with their fist," Wilkerson wrote.

The officers reported that they "deployed chemical weapons" and used physical force to extract Hastings from the alleged assault. "Marvin Parker was physically combative and verbally abusive toward Hastings and officers," Wilkerson's report said.

During the hearing on Thursday, defense attorney John Norton cross-examined witnesses at great length about what they saw that evening. Norton attempted to assert that the Parkers were in fear for their safety from an angry mob and asked witnesses if they observed anyone throw objects or pull a knife on the Parkers.

Duke testified he saw Smotherman struck so hard by Parker's vehicle that he "flew threw the air." A member of the pit crew, Gary Henderson, stated that he saw "banging" on the track between the Smotherman and Parker cars and stopped Marvin to ask why he was doing it. Henderson said that Parker said nothing and instead gave him an obscene gesture.

Norton told the T-G in June that "things did not happen in the way the officers reported."

I don't think people are against racing, Just people hitting other people with cars. Why was he not charged with attempted vehicular manslaughter? That just baffles me; isn't a car a weapon in the eyes of the law?

Unfortunately we as racers and race fans have no one to blame but ourselves. We had a chance to change the image of racing and the personalities of the sport. We live down to the stereo types that the non racing communities have of us. We can clean up this image and eliminate the trouble makers if we choose to do so. However we choose to pass off such behavior as boys being boys. If tracks got serious about rough driving and strictly enforced behavior rules in the pit area and eliminated the admission of casual fans from the pits. These items would go a long way to eliminating a lot of the problems we have. We are seeing more and more of these incidents being sent through the court system. It is only a matter of time till anti racing people in a community seize on this and try to have racing declared a nuisance and we could lose a lot of tracks because of it.

I have been going to the races at Duck River for atleast half my life. Since I have had children of my own I do not go to Duck River. If I do my kids stay at home. This racetrack is dangerous. I have seen drinking and worse there. If you drink and drive on the street you go to jail. why not the same on the track. Dont get me wrong I am not against drinking but not if your going to be in the pits of a racetrack. And sorry Wilky but you are going to have to get more guys in there and help you not just the can of chemical weopon you carry. I have been sprayed by him before, I was at the consession stand and a fight broke out behind me. Two drunk guys, not racers might I add and before I know it I was sprayed. Not having anything to do with them.Anyways like I said stop the drinking and mor security and maybe the Duck will be a safer place.

Why am I not surprised that grandpat is shouting out his/her defense of the alleged wrongdoers? The only thing missing in this latest tirade is her/his accusations against the authorities or officers who arrested them. I'll give it a little time, I'm sure that will be forthcoming.

Grandpat, I agree witnesses can be unpredictable. However, when a witness is also an alleged victim, the court treats them a bit differently. This case will be presented to the grand jury, and if those folks find that there is enough probable cause to send the case on up to Circuit Court, then we'll get to hear the facts at that time. One fact is clear, someone was injured to the point of needing corrective surgery. If one or both of those driver's caused those injuries, they should be held accountable.

I think all the parker boys have anger problems they have a brother that has been arrested for assault also. Anger management anyone?

I think its a darn shame.You can't even go watch the races for the fun of a family outing.

My question is: Why was a 12 year old in the pitts. Thought they had to be 18 for insurance reasons.Under 18 has no business in the pitts for this reason of out break fighting.And too much traffic going on in pitts. Drivers shouldn't have to watch out for children.

Well at least these men have good old Mr Norton.If ya do a crime,hes the lawyer to have.

I think theres more to this story then what the Duck River Raceway Bullys are not admitting to every thing.

I think lie detecter tests should be given.
