Attackers injure man, take money and phone

Tuesday, November 10, 2009
A Shelbyville man told police he was attacked and robbed outside a Courtland Drive home early Friday night.

Carlos Garcia said two men punched and kicked him about 6:15 p.m. while taking his wallet, which contained approximately $600, and cell phone.

Garcia suffered a severe cut above his left eye and cut lips, police said, and was treated and released at Heritage Medical Center.

The attack occurred as Garcia was leaving his ex-girlfriend's home after an unsuccessful attempt to make contact, according to police.

Taser used on suspect

A man who had just been involved in a traffic accident Sunday was shocked with a Taser twice while attempting to get away, Shelbyville police said.

Samuel Kyle Kelley, 19, of Winchester is accused of almost running his vehicle into Officer Jose Garza.

"I then drew my weapon and kept yelling and ordering him to stop and place the vehicle in park," Garza said in his report. "Officer Tory Moore and I approached the vehicle and told him to keep his hands up."

Kelley refused the order and resisted attempts to remove him from the vehicle, Garza said.

"I then unholstered my Taser, took the cartridge off and drive stunned him," Garza said. "He continued to disobey our orders and started putting his hands in his pockets. I again drive stunned him to get him to comply with my commands."

"Drive stunning" a suspect involves placing the flat end of a Taser against a suspect and transmitting a charge without deploying probes, according to the manufacturer's Web site.

Kelley denied being involved in an accident after being placed in a patrol car, Garza said. A witness told police Kelley had been driving in circles on North Main before striking the pole.

Charges of DUI, assault, resisting arrest and violations of the implied consent and drinking age laws were filed against Kelley, who jail records indicate was released on $5,750 bond
