SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, on May 30, 3023, by Tennessee Deed of Trust and

Security Agreement (the “Deed of Trust”) of record as Instrument

Number 23003615 in Deed Book TD1086 and Paged 962-974,

Register’s Office for Bedford County, Tennessee, Barbara K.

Adams, Trustee of the God’s Grace Trust II, conveyed to Richard

J. Schoepke, Trustee, the hereinafter described real property to

secure the payment of a Promissory Note (the “Note”) and other

indebtedness as described in said Tennessee Deed of Trust and

Security Agreement; and

WHEREAS, Richard J. Schoepke resigned as Trustee under

the Deed of Trust, and Matthew R. Murphy was appointed as

Substitute Trustee pursuant to a certain Appointment of Substitute

Trustee of record as Instrument Number 25001250 in Deed Book

TD1144 and Pages 585-586, said Register’s Office, Beford County,

Tennessee; and

WHEREAS, default in the payment of the indebtedness secured

by said Deed of Trust has been made; and the entire balance of

which having been declared due and payable in accordance with

the terms of said Note and Deed of Trust, the owner and holder

of said indebtedness, GBC Senior Debt Fund, LLC, has directed

me, the undersigned, Substitute Trustee, to foreclose said Deed of

Trust and to advertise and sell the real property in satisfaction of

said debt and the cost of foreclosure, in accordance with the terms

and provisions of the Note and Deed of Trust.

NOW, THEREFORE, by virtue of the authority vested in me by

said Deed of Trust, I will on the 9th day of May, 2025, offer for sale

and will sell the following described real property on the premises

at 1608 Madison Street, Shelbyville, Tennessee 37160, at 10:00

a.m., to the last, highest, and best bidder for cash, in hand, and free

from the equity of redemption, any statutory right of redemption,

homestead, dower, and all other exemptions and marital right, all

of which were expressly waived by the terms of said Deed of Trust,

subject to, however such prior encumbrances and priority tax liens

as may appear of record in said Register’s Office.

The property herein to be foreclosed is described as follows:

Land in the Third (3rd) Civil Distsrict of Bedford County, Tennessee

bounded and described as follows:

TRACT NO. 1: Being all of Lot No. 1 and the East 30 feet of Lot

No. 2 in the Forrest Hills Subdivision No. 3 to the Town of Shelbyville,

a plat of which is of record in Deed Book 62, page 596, Register’s

Office of Bedford County, Tennessee. Said property fronts 81.5

feet on the South side of U.S. Highway 41 A (Madison Street) and

is bounded on the North by highway; on the East by Melton, on

the South by Forrest Hills Subdivision and on the West by Brent.

TRACT NO. 2: Being within the Corporate Limited of the City

of Shelbyville Tennessee, being an easter eleven (11) feet of the

original Lot No. 3 in Forrest Hills Subdivision No. 3, a plat of which

is of record in Deed Book 62, page 596, Register’s Office of Bedford

County, Tennessee, and is bounded on the North by Madsion (sic)

Street (U.S. Highway 41 A); on the East by Treemont Drive; on the

South by Forrest Hills Subdivision No. 2; on the West by Cecil Milton.

TRACT NO. 3: Being the East 70 feet of Lot No. 2 and the West

20 feet of Lot No. 3 in the Forrest Hills Subdivision No. 3 to the Town

of Shelbyville, a plat of which is of record in Deed Book 62, page 596,

Register’s Office of Bedford County, Tennessee, to which reference

is here had for a more definite description. The combined frontage

conveyed by this instrument is 90 feet by 200 feet.

The general boundaries of the above three (3) described as

follows: Bounded on the North by Highway 41 A (Madison Street)

approximately 185.5 feet; on the East by Treemont Drive; on the

South by Wayne Adams, and on the West by O.V. Brent, noted as

Parcel 90HC2, Tax Assessor’s Office of Bedford County, Tennessee.

TRACT NO. 4: Being the East 22.5 feet of Lot No. 6 of the Forrest

Hills Subdivision No. 2, a plat of which is recorded in Deed Book 62,

page 371, Register’s Office of Bedford County, Tennessee, reference

to which is here made for a detailed description; to generally be

bounded and front on the North by Highway 41 A (Madison Street)

22.5 feet; and run back South in parallel lines 160 feet noted as a

portion of Parcel 90HC1, Tax Assessor’s Office Bedford County,

Tennessee.

INCLUDED IN THE ABOVE DESCRIPTION, BUT EXPRESSLY

EXCLUDED FROM THE TRANSFER AND CONVEYANCE is a

certain tract of land heretofore conveyed to Harold W. Adams and

wife, Ethelene F. Adams, by Deed dated December 9, 1987, of

record in Deed Book 188, page 599, Register’s Office of Bedford

County, Tennessee: Beginning at a metal pin in a ditch on the

West margin of Treemont Drive at the Northeast corner of the H.W.

Adams property, and the Southeast corner of the property herein

described, said metal pin being 200 feet South of the South margin

of Madison Street; thence leaving the said West margin North 81

degrees 38 minutes West 182.50 feet to a metal pin; thence North

8 degrees 35 minutes East 18.0 feet to a point; thence South 79

degrees 07 minutes East 182.65 feet to a point on the West margin

of Treemont Drive; thence following the said west margin South 8

degrees 35 minutes West 10.0 feet to the point of beginning, and

being a portion of Lots No. 1, 2, and 3 of Forrest hills Subdivision, a

plat of which is recorded in Deed Book 62, page 596 and a portion

of the property in Deed Book 164, page 737, lying in the Civil District

of Bedford County, Tennessee. As per the survey of Rex Northcut,

a licensed surveyor, dated 12-01-87.

Being the same property conveyed to Chris Talley and Amy

Talley, husband and wife, by deed recorded March 3, 2014, of

record in Deed Book 319, page 502, Register’s Office of Bedford

County, Tennessee.

Being the same property conveyed to John Adams, by deed from

Chris Talley and Amy Talley, of record in Deed Book D374, Page

682, Register’s Office of Bedford County, Tennessee.

Also being the same property conveyed to Barbara K. Adams,

Trustee of the God’s Grace Trust II, by Quitclaim Deed from John K.

Adams, of record in Deed Book D375, Page 605, Register’s Office

of Bedford County, Tennessee.

The conveyance was made subject to setbacks, easements and

all other matters as shown or set out on plat recorded in Deed Book

62, page 596, and Deed Book 62, page 371, Register’s Office of

Bedford County, Tennessee.

This is improved property with a mailing and street address of

1608 Madison Street, Shelbyville, Tennessee 37160 (Tax Map 90H;

Group C; Parcel 2). Others with an interest in the property, include:

Tennessee Deed of Trust, Security Agreement and Financing

Statement executed by John Adams to Jeremy B. Bell, Trustee, of

record as Instrument Number 22005259 in Deed Book TD1057 and

Pages 376-388, said Register’s Office to secure Chris Talley and

Amy Talley payment of a Promissory Note dated June 22, 2022, with

an original balance of $940,000.00, payable as specified therein.

Tennessee Deed of Trust and Security Agreement executed by

Barbara K. Adams, Trustee of the God’s Grace Trust II, to Richard

J. Shoepke, Trustee, of record as Instrument Number 22008906 in

Deed Book TD1070 and Pages 359-371, said Register’s Office to

secure GBC Senior Debt Fund, LLC, payment of a Promissory Note

dated November 2, 2022, with an original balance of $325,000.00,

payable as specified therein.

Memorandum of Land Lease Agreement executed by Scotty

Outdoor, LLC, and Adams Barbara K Trustee, of record as Instru-

ment Number 24005205 in Deed Book TD1126 and Page 95, said

Register’s Office.

The sale will be for cash and without warranty of any kind, in-

cluding the location, condition or setback of the improvements on

the property. The property is subject to any and all easements or

restrictive covenants of record with the Register’s Office, Bedford

County, Tennessee. Proceeds of the sale will be applied in accor-

dance with the provisions of the Deed of Trust. If the highest bidder

is unable to comply with the terms of the sale, undersigned reserves

the right to sell the property to the next highest bidder able to com-

ply or to re-advertise the sale if he so chooses. The undersigned

also reserves the right to postpone the date and time of sale upon

announcement at the time and place specified above.
